Business Identity Recovery Program now available

In January 2026 the Minnesota Secretary of State created the Business Identity Recovery process, a free and fast way to help Minnesotan businesses correct records affected by business identity theft.

With new legal authority, the office can investigate and redact illegitimate filings once a business owner reports a wrongful filing. 

If your name, address, or business information was used in filings without your permission, you may be a victim. Common examples include:

• Being listed as a registered agent or organizer without consent
• Your home address used as a business address
• A business created using your identity
• Changes made to an existing business record without approval

Affected individuals can submit a Declaration of Wrongful Filing to the Secretary of State for investigation. To prevent business identity theft:

• File your annual renewals on time
• Keep a valid official email address on file for notices
• Submit business changes promptly
• Regularly check your business details online and report unauthorized updates
